PUBLIC OFFER AGREEMENT
for the sale of goods, veterinary medicinal products, and live animals in the online store «Homyak» 

1. GENERAL PROVISIONS
1.1. This Public Offer Agreement, hereinafter referred to as the Agreement, is an official offer of Sole Proprietor Stepantsov Stanislav Oleksandrovych, EDRPOU code 3367413676, an individual entrepreneur acting in accordance with the current legislation of Ukraine, located at: 02068, Kyiv, Revutskoho Street, building 29-B, and operating under the simplified taxation system. The Seller organizes the sale of Goods through the online store https://homyak.com.ua/ and provides customers with access to the online store, e-mail: [EMAIL], phone: [PHONE], hereinafter referred to as the Seller, to conclude a sale and purchase agreement for goods, veterinary medicinal products, and/or live animals through the «Homyak» online store on the website https://homyak.com.ua/.
1.2. This Agreement is concluded in accordance with the Civil Code of Ukraine, the Law of Ukraine «On Electronic Commerce», the Law of Ukraine «On Consumer Protection», and legislation in the field of veterinary medicine and the protection of animals from cruelty.
1.3. Placing an order on the Website, clicking the «Order», «Place an Order», «Buy», or «Pay» button, or paying for an order constitutes the Buyer’s full and unconditional acceptance of this Offer.
1.4. The Seller has the right to amend the terms of the Agreement by publishing a new version on the Website. The version in force at the time the specific order is placed shall apply to that order.

2. TERMS
2.1. Buyer means a person who has placed an order and accepted the terms of this Agreement.
2.2. Goods means any products presented on the Website, including food, accessories, care products, veterinary medicinal products, and other pet products.
2.3. Veterinary medicinal product means a veterinary product that is subject to special conditions of sale, use, storage, or dispensing.
2.4. Live animal means an animal sold through the Website, including a hamster, parrot, rodent, bird, fish, or any other animal sold by the Seller.
2.5. Order means a request placed by the Buyer for the purchase of goods and/or a live animal through the Website or another communication channel of the Seller.


3. SUBJECT OF THE AGREEMENT
3.1. The Seller undertakes to transfer the ordered goods and/or live animal into the ownership of the Buyer, and the Buyer undertakes to accept and pay for the order under the terms of this Agreement.
3.2. The name, price, quantity, characteristics, availability, expiration date, and other terms are specified in the product card on the Website, in the order confirmation, and/or in the accompanying documents.
3.3. The information on the Website is provided for informational purposes. If certain characteristics of the goods or live animal are important to the Buyer, the Buyer must clarify them with the Seller before placing the order.

4. ORDER PLACEMENT AND CONFIRMATION
4.1. The Buyer places an order through the Website or by another method available from the Seller.
4.2. The Buyer is obliged to provide accurate information necessary to fulfill the order.
4.3. The Seller has the right to clarify order details, verify the Buyer’s information, and request additional information or documents if this is necessary for the sale of goods, a veterinary medicinal product, or a live animal.
4.4. The order is considered accepted for processing after confirmation by the Seller by phone, message, letter, invoice issuance, or actual acceptance of the order for fulfillment.
4.5. The Seller has the right to refuse to confirm or fulfill an order if:

  • the Buyer has provided incomplete or inaccurate information;
  • the goods or live animal are unavailable;
  • a technical error has been detected in the price, description, or availability;
  • additional documents or confirmation are required for the sale of a veterinary medicinal product, and the Buyer has not provided them;
  • delivery of a specific product or live animal is impossible or unsafe;
  • there are other grounds provided by law or by this Agreement.


5. PRICE, PAYMENT, AND DELIVERY
5.1. Prices on the Website are indicated in Ukrainian hryvnias. Delivery costs, cash-on-delivery fees, and commissions may be paid separately.
5.2. The Seller has the right to change prices before the order is confirmed.
5.3. Payment is made using the methods available on the Website or agreed upon with the Seller.
5.4. The Seller has the right to require full or partial prepayment, in particular for live animals, veterinary medicinal products, or certain categories of goods.
5.5. Delivery is carried out by the methods indicated on the Website or agreed upon with the Buyer. The delivery time depends on product availability, delivery location, delivery method, the carrier’s operations, the specifics of the goods or live animal, and other circumstances.
5.6. Upon receiving the order, the Buyer or Recipient is obliged to check the integrity of the packaging, completeness, compliance with the order, and, in the case of a live animal, its general visible condition to the extent possible.
5.7. If damage, non-compliance, or obvious defects are discovered, the Buyer must immediately notify the Seller and, if the order was delivered by a carrier, record the issue with the carrier.
5.8. The risk of accidental loss of or damage to the goods passes to the Buyer from the moment of actual transfer, unless otherwise provided by law.

6. RIGHTS AND OBLIGATIONS OF THE PARTIES
6.1. The Seller is obliged to transfer the confirmed order of proper quality, provide the Buyer with information about the goods, payment and delivery terms, and sales rules, and comply with legal requirements.
6.2. The Seller has the right to:

  • change the assortment, prices, and terms of sale before order confirmation;
  • clarify the order and verify the Buyer’s information;
  • refuse to sell a veterinary medicinal product or live animal in cases provided for by this Agreement or by law;
  • restrict delivery methods for certain goods and live animals.

6.3. The Buyer is obliged to:

  • provide accurate information for the order;
  • pay for and accept the order;
  • inspect the goods/live animal upon receipt;
  • follow the instructions for use, storage, and care;
  • in the case of purchasing a live animal, provide proper conditions for keeping it;
  • in the case of purchasing a veterinary medicinal product, take into account the animal’s species, age, weight, health condition, indications, and contraindications.


7. SPECIAL TERMS FOR THE SALE OF VETERINARY MEDICINAL PRODUCTS
7.1. Information about veterinary medicinal products on the Website https://homyak.com.ua/ is for reference purposes only and does not constitute individual veterinary advice, a diagnosis, or a treatment plan.
7.2. Before purchasing and using a veterinary medicinal product, the Buyer is obliged to read its description, instructions, method of use, and contraindications, and to check whether the product is suitable for the specific animal.
7.3. If the sale of a specific veterinary medicinal product requires a prescription, appointment, confirmation, or other documents, the Buyer is obliged to provide them at the Seller’s request.
7.4. The Seller has the right to refuse to sell a veterinary medicinal product or cancel the order if the required documents are not provided, if there is doubt regarding the legality of the sale, or if the selected delivery method does not ensure proper transportation or storage of the product.
7.5. The Seller shall not be liable for the consequences of using a veterinary medicinal product if they arise due to failure to follow the instructions, incorrect dosage, use for the wrong animal species, concealment by the Buyer of essential information about the animal, violation of storage conditions after receipt, or self-treatment without the necessary consultation of a veterinarian.

8. SPECIAL TERMS FOR THE SALE OF LIVE ANIMALS
8.1. The Seller transfers live animals in compliance with the basic requirements of legislation on the protection of animals from cruelty.
8.2. The Buyer understands that the condition of a live animal after transfer may depend on adaptation, stress, transportation, temperature, keeping conditions, feeding, contact with other animals, and other factors.
8.3. Before placing an order, the Buyer is obliged to make sure that they have proper conditions for keeping the animal and the ability, if necessary, to consult a veterinarian.
8.4. The Seller has the right to refuse the sale or transfer of a live animal if there are grounds to believe that the Buyer will not ensure proper keeping conditions, or if the delivery or transfer of the animal is unsafe.
8.5. From the moment the live animal is transferred to the Buyer, the risks related to its further keeping, adaptation, transportation, and health condition pass to the Buyer, except in cases where it is proven that the issue existed before the animal was transferred due to the Seller’s fault.
8.6. The Seller shall not be liable for any deterioration in the animal’s condition after transfer if it occurred due to improper keeping, incorrect transportation, stress, violation of temperature conditions, lack of veterinary care, or other circumstances that arose after the transfer and are beyond the Seller’s control.


9. RETURNS, EXCHANGES, AND CLAIMS

9.1. Returns, exchanges, and the review of claims are carried out in accordance with the legislation of Ukraine, this Agreement, and the rules published on the Website.
9.2. The Buyer has the right to submit a claim in the event of receiving goods of improper quality, non-compliance with the order, damage, incomplete set, expired goods, or other violations.
9.3. The Buyer must notify the Seller of obvious defects, damage, or non-compliance with the order as soon as possible, preferably on the day of receipt or within 3 days.
9.4. The claim must include the order number, a description of the issue, and, if possible, photos/videos confirming the defect or violation.
9.5. The Seller has the right to request additional materials and, in the case of live animals, also a veterinarian’s report or other confirmations necessary for reviewing the claim.
9.6. The return of veterinary medicinal products of proper quality is considered with regard to the legal restrictions applicable to the relevant category of goods.
9.7. Claims regarding live animals are reviewed individually, taking into account the nature of the animal, the time when the issue was discovered, the conditions of transfer and transportation, and the evidence provided.


10. LIABILITY OF THE PARTIES

10.1. The Parties shall be liable in accordance with the legislation of Ukraine and this Agreement.
10.2. The Seller shall not be liable for:

  • the consequences of the Buyer providing inaccurate information;
  • delivery delays caused by the carrier or by circumstances beyond the Seller’s control;
  • the consequences of improper use of goods, self-treatment of animals, failure to follow instructions, incorrect dosage, or violation of storage conditions;
  • deterioration in the condition of a live animal after its transfer for reasons beyond the Seller’s control.

10.3. No provision of this Agreement shall limit the consumer’s rights to an extent less than that provided by the legislation of Ukraine.


11. PERSONAL DATA AND OTHER PROVISIONS

11.1. By placing an order, the Buyer consents to the processing of their personal data to the extent necessary for placing, fulfilling, delivering, and paying for the order, communicating with the Buyer, and complying with legal requirements.
11.2. Disputes shall be resolved through negotiations, and if no agreement is reached, in the manner prescribed by the legislation of Ukraine.
11.3. If any provision of this Agreement is declared invalid, this shall not affect the validity of the remaining provisions.
